Child Relocation in the Midwest

Child relocation laws vary significantly from state to state. For example, although Oklahoma and Missouri have specific child relocation statutes, Arkansas does not. In Arkansas, child relocation procedure is set out only by appellate courts through case law that has developed over time. Oklahoma and Missouri have substantial child relocation case law too, but Oklahoma and Missouri parents, lawyers, and courts also have guidance from statutory procedure established by their respective legislatures.

Oklahoma Child Relocation

Oklahoma has two child relocation statutes and a wide body of case law from the Oklahoma Supreme Court and the Court of Civil Appeals.

Arkansas Child Relocation

Arkansas does not have a statute about child relocation. All Arkansas child relocation guidance is derived from appellate cases.

Missouri Child Relocation

Missouri has a child relocation statute and a multitude of appellate decisions about child relocation disputes. There are effectively two possible modes of child relocation in Missouri: a non-court-ordered relocation where there was no timely objection by the non-relocating parent, or a court-ordered relocation over the objection of the non-relocating parent.
