The Uniform Interstate Depositions and Discovery Act
We assist lawyers across the United States with discovery in Oklahoma and Arkansas
The Uniform Interstate Depositions and Discovery Act (UIDDA) revolutionized interstate discovery in the United States.
Prior to the Act’s enactment, obtaining evidence from another state involved cumbersome and often inefficient methods. Lawyers had to resort to "letters rogatory," which are formal requests to foreign courts to compel testimony or the production of documents. This process was time-consuming, expensive, and prone to delays due to variations in state procedures and potential language barriers. The need for a uniform act arose from the increasing complexity of interstate litigation and the desire for a more efficient and streamlined approach to obtaining crucial evidence. The aim of the UIDDA, created by the Uniform Law Commission in 2007, was to create a consistent and predictable framework for interstate discovery.
The UIDDA brought significant improvements to interstate discovery. It streamlined the process by allowing for the direct issuance of subpoenas from the court in the state where the action is pending. The subpoenas are transmitted to the appropriate court in the state where the discovery is sought. The receiving court, upon receiving a properly issued subpoena, can then issue its own subpoena to compel testimony or the production of documents. This direct method eliminates the need for letters rogatory and significantly reduces the time and expense associated with obtaining evidence from another state. By harmonizing procedures across participating states, the UIDDA promotes efficiency and reduces the potential for delays and disputes.
The UIDDA has made interstate discovery cheaper and more effective for litigants in several ways. The streamlined process reduces (but may not eliminate) the need for local counsel in the state where discovery is sought, saving parties significant legal fees. The clear and concise rules outlined in the UIDDA minimize the risk of procedural errors and subsequent delays or challenges. The increased predictability and efficiency of the UIDDA process can lead to faster resolutions of disputes and reduce overall litigation costs.
